Data Protection

The Data Protection Act 1998 governs the use of personal information through the eight data protection principle.

What’s included

These principles require that personal information is:

processed fairly and lawfully

processed for limited purposes

adequate, relevant and not excessive

accurate and up to date

not kept for longer than is necessary

processed in line with the rights of individuals

not transferred to other countries without adequate protection

The definition of processing is wide and covers virtually any action carried out on a computer.
This includes obtaining, recording, holding, processing and analysing personal information.

If you are processing personal information covered by the Act, you and your staff must comply with the data protection principles. Complying with the principles is largely a matter of common sense and you may well be meeting the requirements already.

Frequently Asked Questions

Does my business need to comply with the Data Protection Act?

If your business handles any personal information (names, addresses, emails, etc.), then yes, you must comply with the Data Protection Act 1998. Even basic record-keeping falls under the definition of “processing” in the Act.

What are the "eight data protection principles"?

The eight principles outline how personal information should be treated. They emphasize fairness, lawful processing, limited purposes, accuracy, retention limitations, individual rights, security, and international data transfers. EAC Business Services can help you understand and meet these principles.

What types of security measures do I need for my data?

Appropriate security measures depend on the sensitivity of the data and the size of your business. Examples include password protection, access controls, encryption, and secure storage. EAC can guide you on implementing essential data security practices.

Is registering with the Information Commissioner's Office (ICO) mandatory?

Registration is required if your business handles sensitive public data, like medical records or financial information. If you’re unsure, EAC can advise you on your registration needs. Our £99 registration service simplifies the process for a 12-month period.

Remember, complying with data protection isn’t just a legal requirement, it’s also vital for building trust with your customers and protecting their privacy. EAC Business Services is committed to helping you navigate the data protection landscape with ease and confidence.
